Forsyth County Criminal Court Cases
Forsyth County divides criminal court cases by charge level. Superior Court is the felony trial court. State Court hears county misdemeanors and traffic cases, while Cumming Municipal Court keeps its own city ordinance and qualifying traffic docket. A defendant age 16 or younger is routed to Juvenile Court. This court split is vital because a search in the wrong docket can produce no result even when a public file exists.
The Clerk of Superior, State and Juvenile Courts is the custodian for filed county cases. The courthouse counter is at 101 E. Courthouse Square, Suite 1007, Cumming, GA 30040. Call 770-781-2120 option 5 for Superior criminal questions or option 3 for State criminal and traffic matters. The clerk records dates but does not schedule them, so a hearing date appears online only after Court Management enters it.
Forsyth Criminal Court Divisions
Georgia does not use a numbered degree system for all crimes. A felony is an offense punishable by more than 12 months, life imprisonment, or death under the offense statute. A misdemeanor is generally punishable by up to 12 months and a fine up to $1,000. A high and aggravated misdemeanor can carry up to 12 months and a fine up to $5,000. Those labels point a Forsyth County case toward the proper court.

The Bell-Forsyth Judicial Circuit District Attorney prosecutes felonies. The Forsyth Solicitor-General separately prosecutes State Court misdemeanors and traffic offenses. That prosecutor split also matters when a person seeks a corrected disposition or record restriction.

The clerk directs online researchers to re:SearchGA. Registration is required, and online document purchasing may cost extra. A case number is the strongest identifier. A party name, filing range, and case type can narrow a name search. Older or unscanned papers require an email, mail, or counter request instead of repeated portal guesses.

Online results may show the case number, filing date, assigned division, party role, charges, docket events, attorneys, hearing data, and document-purchase status. Prices and availability vary. Sensitive identifiers, sealed matters, juvenile material, and protected victim details should not appear in public view.
Inside a Forsyth County Case File
A Forsyth County criminal case file follows one prosecution. It is not the same as a jail entry or a fingerprint-linked GCIC history. The file may contain an accusation or indictment, motions, hearing events, a plea, judgment, sentence, and public attachments. The docket index can summarize these events, but the filed order controls the outcome.

Certified and restricted copies cannot be emailed. The clerk calls with the estimate and can take qualifying card payment by phone; mailed payment uses a business check, money order, or cashier's check.
How a Criminal Case Moves
The filed court case begins when a prosecutor presents an accusation or a grand jury returns an indictment where required. At arraignment, the charge is formally addressed and a plea is entered. Pretrial filings can test evidence or resolve procedural issues. The case may end through dismissal, a prosecutor's nolle prosequi, a plea, or trial. A conviction then moves to judgment and sentencing.

Initial arrest charges can change before filing. For that reason, the accusation or indictment and final disposition are more reliable for understanding the prosecution than the first booking label. A court date may also lag online until Court Management enters it.
Forsyth Case Number Judge Suffixes
Forsyth County publishes a local shortcut for Superior Court case numbers. A final suffix of 1 maps to Chief Judge Jeffrey S. Bagley, 2 maps to Judge David L. Dickinson, and 3 maps to Judge Philip C. Smith. The suffix helps identify the assigned division, but it is not a case status or disposition code.
- Accusation
- A prosecutor's charging paper used without a grand-jury indictment where Georgia law allows.
- Dead docket
- A Georgia status that pauses prosecution indefinitely. It is not an acquittal.
- Nolle prosequi
- The prosecutor's formal choice not to proceed with a charge at that time.
- Disposition
- The outcome or current resolved status recorded for a count or case.
Read each term in the actual docket context. A status line can describe one count while other counts continue, and a dead-docket entry is not the same event as a dismissal order.
Forsyth Accountability Court Records
Forsyth County's Mental Health C.A.R.E. Program is a multiagency accountability court, not a separate public record database. It generally lasts at least 24 months in four phases. Drug Court also generally lasts at least 24 months and no more than four years. DUI Court began in 2006 and generally lasts at least 18 months across five phases.
Participation and program progress can generate filed hearings, orders, or disposition events in the underlying criminal case, subject to confidentiality rules. Search the trial-court file for public judicial action. Do not treat treatment-provider files, supervision notes, or program screening material as open court records.

The division should be the first stop for an indictment, felony disposition, or certified felony judgment. State Court remains the correct counter for county misdemeanor and traffic files.

Case Record Access and Restrictions
The Georgia Open Records Act favors access to agency records, subject to exemptions, while court rules and orders also govern judicial files. Public views may omit juvenile matters, sealed papers, victim information, Social Security and account numbers, and protected investigative material. A blank portal result can also reflect spelling, a filing delay, an older unscanned paper, or a Cumming Municipal Court case outside the county trial-court route.
A dismissal in the Forsyth County court file may not have reached GCIC yet. First obtain the final disposition and ask the proper court to transmit a missing or corrected outcome. Then use the GBI restriction process if the arrest cycle qualifies. The clerk can provide records but cannot give legal advice.
